CHESCA Constitution

ARTICLE I: NAME

The name of this organization shall be called the Christian Home Educators Stark County Association, (hereafter, CHESCA). CHESCA is a totally independent home education support group. We recognize no outside authority as a governing body. However, we do reserve the right to develop associations with any other groups which meet our doctrinal or purpose guidelines.

ARTICLE II: PURPOSE

  1. We seek to honor and please the Lord Jesus Christ through promotion of home education by Christian parents.
  2. We seek to facilitate Christian home education in and around the Stark County, Ohio area.
  3. We seek to facilitate the total education, training, and nurturing of our children according to Biblical guidelines.
  4. We seek to use our God-given talents and abilities, provide information, exchange ideas, and to offer group activities to our members.
  5. We seek to encourage one another, promote unity among Christian home educators, and encourage communication within our membership.
  6. We seek to promote the rights of Christian home educators as citizens within the sovereign State of Ohio.
  7. We seek to execute the above intents through the leadership of a Central CHESCA Council, the direction of the officers of CHESCA Nurture Groups, and the participation of the General Membership.

ARTICLE III: MEMBERSHIP

Basic requirements for membership in CHESCA are:

  1. As of 5/1/95 both parents are required to sign the CHESCA Statement of Faith for family membership. If one parent disagrees with the Statement of Faith, that parent may sign a statement of support for his/her spouse. Members prior to 5/1/95 must renew their annual family membership and sign the CHESCA Statement of Faith, or submit a written explanation of why they cannot sign the CHESCA Statement of Faith.
  2. All members must pay Annual Membership Fees, unless said fees are waived by the CHESCA Central Council.
  3. All members must acknowledge and abide by CHESCA rules and policies.
  4. All members must belong to a CHESCA Nurture Group as described in the current CHESCA Policy manual.
  5. Membership in CHESCA may be terminated by a member family at any time by providing notice of same to it's Nurture Group Leader and a member of the CHESCA Executive Committee. Membership of any member may be terminated by a 2/3 majority vote of the CHESCA Central Council whenever in its judgment the best interests of CHESCA will be served thereby.
  6. Membership in CHESCA is for support and resource purposes only. CHESCA does not research, certify, qualify, approve or in any way determine who may or may not home educate. Neither does CHESCA endorse the day-to-day execution of curriculum or the social development program of individual CHESCA members.
  7. All CHESCA members must be home educating, anticipate home educating, or have concluded home educating as defined by current CHESCA Policy.

ARTICLE IV: REGULAR MEMBERSHIP MEETINGS

  1. Regular meetings may occur from time to time throughout the year.
  2. At least one regular meeting shall be required per year. The CHESCA Council shall determine the date of this meeting.
  3. Quorum at regular meetings shall consist of all members who are in attendance.
  4. Any votes shall require a 67% (2/3 majority) approval for enactment.
  5. Written notice of regular meetings shall be sent to the membership of CHESCA at least two (2) weeks in advance. This notice shall also include any mail-in ballots which will be included in the vote.
  6. Regular meetings shall be open to all CHESCA members.
  7. The CHESCA Council shall be responsible to determine the agenda discussed at regular meetings according to the CHESCA Bylaws. This shall include any issues which may require a vote or survey of the membership.
  8. Current CHESCA members may vote (one vote per family).

ARTICLE V: QUALIFICATIONS AND DUTIES OF OFFICERS

CHESCA CENTRAL COUNCIL:

The CHESCA Central Council shall consist of representative(s) from each CHESCA Nurture Group. Each Nurture Group is responsible to appoint its representative(s). This group of representatives shall be collectively known as the CHESCA Central Council. Each council member shall have one (1) vote.

QUALIFICATIONS FOR CHESCA CENTRAL COUNCIL:

  1. Council members must have an active personal faith in Jesus Christ and adhere to basic Christian doctrine.
  2. Council members must sign the CHESCA Statement of Faith without any disagreement with the same.
  3. Council members shall display appropriate Christian behavior.
  4. Council members shall have been a member in good standing with CHESCA for at least one year, and be a current member of CHESCA.
  5. Council members shall have had at least two (2) years prior home education experience.
  6. Council members shall have read the CHESCA Constitution and Bylaws and be willing to work within their provisions.

EXECUTIVE COMMITTEE:

The CHESCA Central Council will appoint the following officers from within the CHESCA Central Council: the Director, Secretary, and Treasurer. These three officers shall constitute the Executive Committee and shall be empowered by the CHESCA Central Council to be the statutory agents on behalf of CHESCA.

DIRECTOR:

The Director of the CHESCA Central Council will act as the director of regular membership meetings. The Director shall preside over CHESCA Central Council meetings and any other meetings of the Council with the CHESCA Nurture Group leaders. All other duties of this office shall be executed according to current CHESCA policy.

SECRETARY:

The Secretary shall keep on file an accurate record of the minutes of the meetings of the CHESCA Central Council and the CHESCA regular meetings. This office shall also maintain an accurate record of current CHESCA members. Any other duties of this office shall be executed according to current CHESCA policy.

TREASURER:

The Treasurer shall keep on file all financial records of the CHESCA Central Council and make monthly reports to the Council. The Treasurer will also keep on file financial information made available by the CHESCA Nurture Groups, and provide regular reports to the Central Council. Any other duties of this office shall be executed according to current CHESCA policy. This office shall expend the funds of CHESCA for purposes as may be directed by the CHESCA Central Council. No part of the net earnings of CHESCA shall be used to the benefit of, or be distributed to its members, trustees, officers, or private persons, except that CHESCA shall be authorized and empowered to pay reasonable compensation for the services rendered and to make payments and distributions in furtherance of the purpose set forth in Article II above.

OTHER COMMITTEES:

The CHESCA Central Council may establish additional committees as needed to carry out the functions of CHESCA. At least one Council member must act as chairman of the committee, although members of the general membership may work on the committee. The chairman's responsibility is to maintain order in the committee and to provide regular reports to the CHESCA Central Council regarding the committee.

ARTICLE VI: DISCIPLINE AND CONFLICT RESOLUTION

If a conflict occurs within CHESCA that directly affects the unity and functioning of the organization, the following steps shall be taken:

  1. The offended party shall communicate the grievance lovingly and tactfully to the offender, with the goal of reconciliation. Every effort shall be made to resolve the conflict at this level.
  2. If personal reconciliation is impossible, the offended individual may take the grievance to an appropriate individual, CHESCA Nurture Group officer, or an appropriate CHESCA Central Council member. Through prayer and searching biblical principles this group shall make every effort to resolve the problem.
  3. If there is still no movement toward reconciliation, the offended party may request that the CHESCA Central Council be contacted for assistance. The CHESCA Central Council shall be resolved to hear only the issues involved and not engage in, nor encourage, attacks upon personalities.
  4. After a search the Scriptures, prayer, reflection and research, the CHESCA Central Council shall be empowered to administer the appropriate disciplinary action. This may include a person being asked to resign from office, a person being asked to abide by CHESCA policy, or a person being removed from CHESCA membership. The final decision of the CHESCA Central Council shall be binding upon all individuals involved and they shall be under the authority of the Council.
  5. All parties involved in conflict resolution and/or disciplinary action shall ever bear in mind that the goal of this process is restoration and reconciliation. The focus of this process shall be unity within the CHESCA membership.
  6. Scripture Resources: Matthew 18:15-17, Galatians 6:10, Ephesians 4:29,32, Ephesians 5:3-4, Ephesians 6:10-12, Proverbs 27:5-6, Titus 3:9-11.

ARTICLE VII: AMENDMENTS

This Constitution may be amended at a regular meeting or by mail-in ballot upon the recommendation of the CHESCA Central Council, provided that any proposed changes be written and mailed to the CHESCA membership at least two (2) weeks prior to the meeting or voting deadline. This written notice shall also include the meeting time and place or instructions for a mail-in ballot. Any amendments to this Constitution require a 75% (3/4 majority) vote for enactment, providing that 51% or more of the current CHESCA membership participates in said vote. The CHESCA Statement of Faith and the CHESCA Statement of Purpose shall be excluded from the above amendment process. The CHESCA Statement of Faith and the CHESCA Statement of Purpose may only be amended by unanimous (100%) CHESCA Central Council vote for enactment.

ARTICLE VIII: DISSOLUTION

Upon the dissolution of the Christian Home Educators Stark County Association (CHESCA) the assets, after all existing debts and financial obligations have been satisfied, shall be distributed to the Christian Home Educators of Ohio (CHEO), Columbus, Ohio, or the CHESCA Central Council shall select an organization which represents Christian home educators. Any assets which are not so dispersed shall be disposed of by the Court of Common Pleas of Stark County, Ohio, exclusively for such purposes as described in Article II above.
